All orders are accepted and executed on the understanding that the purchaser is bound by the following conditions of sale, which shall constitute a binding contract.

ORDERS

1. No minimum order - minimum delivery charge £25/E40.
2. Orders over £1000/E1500 - FREE DELIVERY (at company's discretion) excluding the following areas: Scotland, South Wales, Cornwall, Norfolk, West Coast Of Ireland.
3. In the event of split/part deliveries at the purchaser's request, all deliveries will be subject to the above conditions.
4. Requests for discounts for uplift of own goods WILL NOT be considered when orders are collected at the purchasers own request.
5. Customers requiring goods to be uplifted by couriers MUST make their own arrangements.

CONFIRMATION OF ORDER

Unless orders are confirmed prior to delivery, the company will not accept responsibility for any order discrepancies.

PRICES

The Company reserve the right to vary the prices without prior notice. Orders already in the system will be charged at the price current at the time of placing the order. All prices are exclusive of VAT which will be charged at the appropriate rate.

DESPATCH

Goods are despatched in protective wrapping and boxed and under no circumstances will unpacking be undertaken at time of delivery by Chairs n Graces staff. All packaging is inspected and confirmed undamaged prior to despatch.

DELIVERY

Every endeavour will be made to maintain delivery times and dates but no responsibility for late delivery due to circumstances beyond our control will be accepted. Under no circumstances shall such a delay be grounds for refusing a delivery. Deliveries are STRICTLY business to business only and under no circumstances will ANY deliveries to your customers be undertaken. An aborted delivery charge of £75/E112.50 will be levied if an agreed delivery is cancelled or refused on the day of delivery. It is sometimes impossible to make a delivery if closing days happen to coincide with our route/day planning. Please ensure that someone is available to receive the goods as planned. Failure to do so will result in the delivery not being made and an aborted delivery charge will apply.

CANCELLATION AND RETURN

Under no circumstances will goods correctly supplied be accepted for return. Any cancellations MUST be made at least 48 hours prior to despatch and delivery. Where less than the required notice is given an abortive fee of £75/E112.50 will apply. PLEASE NOTE: This Company DOES NOT operate on a sale or return basis.

DAMAGES CLAIMS

All damages and discrepancies should be notified in the first instance, by telephone to the Company within 5 working days of receipt of goods. All damage report forms must be correctly completed and returned within 3 days of receipt. Correct claim numbers must be quoted in all enquires relating to the claim. NO LIABILITY will be accepted by the Company for claims beyond the time frame stated. Damaged goods must be returned in original packaging and be ready for uplift by our driver. Failure to comply with this procedure will result in uplift not taking place and such items will not be credited or replaced. Credits for defective goods shall be limited to the purchase price only of the goods in question.

NB: There is no exception to this rule. We recommend that Stockists unpack and inspect the goods before delivery to their customer. Exchanges will be limited to cost of goods and NO other compensation will be paid.

PAYMENT

Proforma payments by cheque or bank transfer must be received prior to despatch of the goods. 30 Day accounts available subject to status. Late payments will incur an administration charge of £20.00 after 14 days of the payment becoming due. Orders in excess of the credit limit will not be accepted. Cheques that are cancelled by customer or returned/ represented by our bank; will incur an administration charge of £50 per cheque per representation.

OWNERSHIP

The ownership shall remain with the Company until such time as all sums owing to the Company have been paid. In the event of goods being ceased by the company for non payment, a charge of 20% of the value will be charged and pursued via the courts.

Where goods have been sold on, a charge of 30% will be claimed in addition to the outstanding debt.

DISCLAIMER

The Company WILL NOT accept liability for loss of sales due to late deliveries, unavailability of stock, or damaged/returned goods. However statutory rights are not affected. THE FURNITURE CONTAINED WITHIN THE CATALOGUE IS PRODUCED TO WITHSTAND THE RIGOURS OF DOMESTIC USE FOR WHICH PURPOSE IT IS ENTIRELY SUITABLE. NO RESPONSIBILITY WILL BE ACCEPTED FOR ANY COMMERCIAL LOCATION.

FORCE MAJEURE

These conditions of sale shall be constructed in accordance with the laws of England and if any question, dispute or difference shall arise between the parties in respect of their interpretation, the same shall be referred by agreement to a single arbitrator under the provisions also being the case of reference to a single arbitrator. We shall incur no liability for failure to perform our obligations here under due to the existence of circumstances which we have not caused and which are beyond our control.

The above conditions supersede all previous Terms and Conditions. These conditions are without prejudice.
